    Subject: Introduction to Law
    Form of study: full-time
    Subjetc´s goals:

    Study of the course is aimed at presenting and discussing the basic terms of law and selected legal institutions under public law, which are necessary for the practice of military professional. The course is focused on the interpretation of the fundamental concepts of the theory of law (legal norm, sources of law, legal facts, etc.) that military professional should operate safely, as well as on selected issues of the creation, implementation and application of laws and internal regulations of Ministry of Defence  of the Czech Republic. In addition, there is also an interpretation of the guarantees of legality, in particular, to legal liability (criminal, administrative, civil liability).

    In the area of ​​public law particular attention is devoted to the Constitutional Law and Administrative Law. In the area of ​​Constitutional Law the interpretation is directed to the constitutional foundations of the security of the Czech Republic , constitutional order, thus the Constitution and the Charter of Fundamental Rights and Freedoms, with emphasis on the system of protection of human rights, international framework of human rights law and special regulation for the soldiers. In the field of Administrative Law course covers in particular the of Administrative Law – Specific Part and Administrative Law – Procedural Part. In the Specific Part of Administrative Law due attention is given to the implementation of legal relations in the field of so-called Security management (organization and activities of public administration in the field of protection of classified information, the intelligence services of the Czech Republic, Police, municipal police and crisis management) and the management of national defence (in particular the organization and activities of public administration in the performance of military duty and its instantiation within the service of a professional soldier) . In the Procedural Part of Administrative Law the course emphasizes the importance of the administrative procedure and administrative procedure for decision-making in matters of military service.

    Graduate of the relevant course will demonstrate:

    • Discusses the legal and organizational aspects of the position of a soldier and commander, including their rights and obligations arising from Czech law and internal regulations of the Ministry of Defence.
    • Presents the general principles of financial legal issues.
    • Interprets basic internal regulations for the performance of soldier´s services
    • Connects legal and internal regulations governing service in the Armed Forces of the Czech Republic.
    • Remembers the principle of the protection of classified information.

    The student:

    • Applies generally binding normative acts of the Czech Republic and the internal regulations of the Ministry of Defence in the management and training of subordinates.

    • Clearly describes social events with an emphasis on their basic legal qualification, and tells the professional and lay public.
    • Residential addresses basic legal issues.
    Subject continuity: Study of the subject does not follow on the study of other subjects. The successor to the course Elemets of Law is the subject International Humanitarian Law
    Conditions for successful completion of the course:

    • Reading compulsory literature. (150 s, 16 hours)

    • Preparation of term paper on an assigned topic in the range of 10 to 15 pages. (10 hours)

    • Preparation of presentation and defence of conclusions term paper. (4 hours)

    • Passing a wrtitten test.
